General Terms & Conditions of Sale
These General Terms and Conditions of Sale govern the offer and sale of products on our web site (Aloharag.com). The products purchased on Aloharag.com are directly sold by Aloha Rag.


Our Businesss Policy
Aloha Rag offers products for sale on Aloharag.com and its e-commerce business services are available exclusively to its end users, i.e. the "Consumers." "Consumer" shall mean any individual who is acting for purposes which are outside his or her trade, business or profession. If you are not a Consumer, please do not buy any products on Aloharag.com. Aloha Rag reserve the right not to process orders received from users who are not "Consumers" and any other order which does not comply with Aloha Rag's business policy. These General Terms and Conditions of Sale exclusively regulate the offer, transmission and acceptance of purchase orders relating to products on Aloharag.com between the users of Aloharag.com and Aloha Rag. The General Terms and Conditions of Sale do not regulate the supply of services or the sale of products performed by third parties which are on Aloharag.com through links, banners or other hypertext links. Before sending orders and purchasing products and services from those third parties, we recommend that you verify the third party's terms and conditions of the web site from which you may be considering purchasing a product, since Aloha Rag shall under no circumstances be deemed liable for the supply of services provided by third parties or for the execution of e-commerce transactions between the users of Aloharag.com and third parties.


How to Execute a Contract with Aloha Rag
In order to place an order for the purchase of one or more products on Aloharag.com, you must fill out the electronic order form and send it electronically to Aloha Rag, following the relevant instructions. The order form contains links to these General Terms and Conditions of Sale and other important policies, information on the main characteristics of each product ordered and the relevant unit price (including all applicable fees), and the type of payment that you may use in order to purchase our products. Please note that the unit price indicated in the order form does not include duties, taxes and fees you may need to pay to local authorities. An order shall be deemed to have been submitted upon the electronic receipt by Aloha Rag of your order form. Before submitting your order form for the purchase of products, please carefully read the General Terms and Conditions of Sale. The order form will be filed in our data base for such a period of time required in order to process your order and as provided by law. Before placing the order form, you will be asked to identify and correct possible input errors. After the contract has been executed, Aloha Rag will keep up your purchase order. Aloha Rag may not keep up purchase orders that do not give sufficient guarantees of solvency or which are incomplete or incorrect, or orders for products that are no longer available. In the above cases, we shall inform you by e-mail that the contract has not been executed and that Aloha Rag has not carried out your purchase order specifying the reasons thereof. If the products displayed on Aloharag.com are no longer available once Aloha Rag has received your order form, Aloha Rag shall inform you within 15 working days of receipt of your order of the unavailability of the ordered products. If the order form has been sent and the price has been paid for items that are no longer available, Aloha Rag will refund you the sum paid. By submitting an order form and contracting with Aloha Rag, you unconditionally accept to observe the provisions of these General Terms and Conditions of Sale. Should you not agree with certain provisions of these General Terms and Conditions of Sale, please do not submit your order form for the purchase of products on Aloharag.com. By sending the order form, you confirm to acknowledge and accept these General Terms and Conditions of Sale as well as all of the further conditions contained on Aloharag.com (also through links.) Upon submission of your order form, Aloha Rag shall send to you, via e-mail, a receipt of the purchase order, containing a summary of the information related to the order form (the products' main characteristics, a detailed indication of the item price, terms of payment and shipping costs). For international orders, please note that all and any item price is provided without duties, taxes or fees that you may need to pay to local authorities to receive the merchandise. Please note as well that due to fluctuations in exchange rates and merchandise components Aloha Rag will not be able to provide you in advance with information on the amount of duties and taxes that may be owed to local authorities. These amounts should be considered above and beyond the total of the order.


Warranties and Indication of Product Prices
On Aloharag.com, we offer for sale luxury and top-quality products. These products are purchased by Aloha Rag directly from fashion houses, manufacturers and dealers, carefully selected by stringent quality control. Aloha Rag does not sell second-hand products, flawed products or products of lower quality as compared to the corresponding standards offered on the market. The main characteristics of products are shown on Aloharag.com inside each product schedule. The products offered for sale on Aloharag.com may not exactly correspond to the real garments in terms of image and colours because of the Internet browser or of the monitor used. Prices are subject to change. Check item prices before sending the relevant order form. Orders from countries not included among those displayed on the Help page cannot be accepted by Aloha Rag. All products come with an inspection label attached. Do not remove the label or relevant seal from the purchased products should you wish to return the purchased product. Should you decide to exercise your right to return purchased products, Aloha Rag will not accept returned products that are returned without the relevant label or seal or that have been altered from their original status or damaged.


Customs and Duties on International Orders
If you order from a country outside United States, upon arrival in your country the contents of your order may likely be subject to customs fees (taxes, duties, processing fees, brokerage fees, etc.), which are the responsibility of the person(s) receiving the order. These fees are not under Aloha Rag's control. For this reason we recommend you verify with your local customs office for more information about these fees before you place an order. Aloha Rag is unable to estimate customs fees, taxes, duties, etc. so please contact your local authorities or customs office for detailed information. Both the item prices as well as the shipping charges you pay to Aloha Rag do NOT include customs fees, import taxes, brokerage fees, or duties. Should you refuse your order at the time of arrival or should you refuse to pay the customs fees when your order arrives, the shipment will be returned to Aloha Rag and we will be charged the customs fees plus return shipping costs. If Aloha Rag has been charged for the above mentioned amounts (taxes, duties, processing fees, brokerage fees, etc.) we will not issue a refund for those amounts.


Payments
Payment of product prices and relevant shipping costs can be made only with a credit card. All details (for example, card number or expiration date) will be sent by encrypted protocol to Cybersource or other banks which provide remote electronic payment services, without third parties having any access thereto whatsoever. Such details will not be used by Aloha Rag except for performing the procedure relevant to your purchase or issuing relevant refunds in the case of returns, in compliance with the exercise of your return right or for reporting cases of frauds to the police. For International order, please note that you may need to pay additional import fees, taxes, brokerage fees and handling fees to your local authorities or customs offices. The price for the purchase of products and the relevant shipping costs, as indicated in the order form, will be charged to your current account only when the purchased products are actually delivered.


Shipping and Delivery of the Products

The information provided in these sections form an integral part of these General Terms and Conditions of Sale and, consequently, shall be deemed to be fully known and accepted by you at the time your order form is sent. We only ship your order to your billing address.

Returns
Aloha Rag will gladly accept all regular priced items that were purchased by credit card and is in its original condition. Sales items are NOT refundable. Items that have the tags cut off or have been worn, used, or washed will not be accepted. Aloha Rag will accept returns within 14 days from the date of delivery. The returned package MUST be postmarked within 14 days from the date of delivery or Aloha Rag will refuse the return. We recommend you to insure your package for unpredictable damages and losses. For further instruction, please check the return claim form enclosed with your shipment. If any package is sent to us without prior authorization, Aloha Rag reserves the right to refuse the package. After Aloha Rag receives, processes and confirms that your returned item meets the Return Policy requirements, you will receive an e-mail notifying you that your refund has been processed. Refunds are processed within approximately 3-5 business days of our receipt of your merchandise. Your refund will be credited back to the same card used to make the original purchase. Remember that we do not refund delivery costs, only the amount paid for the item you have decided to return. Refund times will depend on your credit card company's policies.


Exchanges
Aloharag.com will gladly exchange regular priced items that were purchased by credit card and are in their original condition for another size. Sales items are NOT exchangeable. Items that have the tags cut off or have been worn, used, or washed will not be accepted. Aloha Rag will accept exchanges within 14 days from the date of delivery. The package MUST be postmarked within 14 days from the date of delivery or Aloha Rag will refuse the exchange. Please send an e-mail to love@aloharag.com to confirm the availability of your desired size. We recommend you to insure your package for unpredictable damages or loss. As soon as your exchange is accepted, the desired size will be shipped out. The shipping ($15.00 for US destination, $30.00 for international destination) will be charged on the credit card you used for your original purchase. For further instruction, please check the exchange claim form enclosed with your devilery. If any package is sent to us without prior authorization we have the right to refuse the package.


Sale Price Adjustment Policy
Aloharag.com will gladly offer a sale price adjustment on items purchased up to 7 days prior to the commencement date of a sale. Please be aware that the exact style and size of an item must be available for purchase at the time your request is made before any adjustment in the sale price can be approved. A approved sale price adjustment will be credited back to the credit card used to make the original purchase. We are unable to offer price adjustment on items originally purchased in a sale or discounted price.

Governing Law
The laws of the State of Hawaii (without giving effect to its conflicts of law principles) govern all matters arising out of or relating to these General Terms and Conditions, including, without limitation, their validity, interpretation, construction, performance, and enforcement. All legal proceedings arising out of or in connection with these General Terms and Conditions shall be brought solely in the City of Honolulu, State of Hawaii.


Amendments & Updates
The General Terms and Conditions of Sale may be amended from time to time, in consideration of new laws and regulations but not limited thereto. The new General Terms and Conditions of Sale shall be effective as of the date of publication on Aloharag.com.
